Terms of Service

1. Service Description
AlphaAssist provides an AI-powered virtual assistant service that answers business phone calls, takes messages, schedules appointments, sends SMS and email notifications, and manages social media content on behalf of subscribing businesses ("Customers").
2. Eligibility
You must be at least 18 years old and authorized to act on behalf of the business subscribing to AlphaAssist. By subscribing, you represent that you have the authority to bind the business to these terms.
3. Subscription and Billing
- AlphaAssist is offered as a monthly subscription starting at $39.99/month.
- Subscriptions renew automatically each month unless cancelled.
- Usage exceeding plan limits will incur overage charges as described on our pricing page.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds are not provided for partial months. Charges already incurred (subscription fees and usage overages) are non-refundable.
4. Acceptable Use
You agree not to use AlphaAssist to:
- Send spam, unsolicited messages, or bulk communications.
- Conduct illegal activities or facilitate fraud.
- Impersonate individuals or misrepresent your business.
- Harass, threaten, or abuse callers or recipients of messages.
- Violate any applicable laws, including the Telephone Consumer Protection Act (TCPA).
- Provide tailored professional advice — including financial, legal, or medical advice — through the AI assistant without a qualified professional reviewing the output before it reaches your callers, and without disclosing the AI's role and limitations.
- Engage in or facilitate political campaigning, candidate impersonation, voter suppression, or the creation or distribution of election-related misinformation.
- Place automated outbound calls (robocalls) without prior express consent from the recipient as required by law.
- Threaten child safety; create, distribute, or facilitate sexually explicit material involving minors; or target the assistant at users under 18 without parental or guardian consent.
- Generate hate speech, threats of violence, or material that incites or promotes violence, terrorism, self-harm, or unlawful discrimination.
- Use the assistant to obtain unauthorized access to systems, harvest personal data without consent, or engage in surveillance.
5. AI Voice Features (Disclosure and Voice Cloning)
AlphaAssist uses third-party AI voice technology to generate synthetic speech. By using these features, you agree:
- AI disclosure. Your AlphaAssist assistant will identify itself as an AI when it answers calls. You will not modify the assistant's greeting or system instructions to remove or obscure that disclosure.
- Voice cloning consent. If you use AlphaAssist's voice-cloning feature to create a custom voice, you represent and warrant that you are either the speaker in the source recording, or that you have written permission from the speaker to create and use a synthetic copy of their voice for this purpose. You will not upload recordings of public figures, celebrities, customers, employees, or any other person without their explicit consent.
- No deceptive synthesis. You will not use the cloned voice to impersonate any person without their consent, to take action on their behalf without authorization, or in any way intended to deceive listeners about whether they are hearing a human or AI.
- Flowdown of upstream restrictions. AlphaAssist relies on third-party AI voice and language model providers whose terms of service prohibit the uses listed above. You agree that the prohibitions in these Terms apply at least as strictly as those imposed by AlphaAssist's upstream providers, and that AlphaAssist may suspend or terminate your access to AI voice features if your use violates an upstream provider's policy.
6. SMS Messaging Consent
By using AlphaAssist's SMS features, you confirm that you have obtained appropriate consent from recipients to receive text messages. AlphaAssist sends messages only in response to inbound calls or at the direction of the business owner. You are responsible for compliance with TCPA and other messaging regulations.
7. AI-Generated Content
AlphaAssist uses artificial intelligence to generate voice responses, text messages, emails, and social media content. While we strive for accuracy, AI-generated content may occasionally contain errors. You are responsible for reviewing content posted to social media on your behalf. AlphaAssist is not liable for inaccuracies in AI-generated responses.
8. Data and Privacy
Your use of AlphaAssist is subject to our Privacy Policy. You retain ownership of your business information and customer data. We process data solely to provide the service.
9. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for damages resulting from service interruptions.
10. Limitation of Liability
AlphaAssist's total liability to you for any claims arising from use of the service is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or missed business opportunities.
11. Termination
We may suspend or terminate your account for violation of these terms, non-payment, or abuse of the service. You may terminate your account at any time by cancelling your subscription.
12. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email. Continued use of the service after changes constitutes acceptance.
